These Terms of Service (“Terms”) govern your access to and use of the Houdini Coffee Roasters website, and any purchase you make through it. The site is operated by Houdini Coffee Roasters LLC (“Houdini,” “we,” “us,” or “our”), a Washington limited liability company located at 2325 West Lewis Street, Suite 102, Pasco, WA 99301.

By browsing this site or placing an order, you agree to these Terms. If you do not agree to them, please do not use the site.

1. Eligibility

You must be at least 18 years old, or have the consent and supervision of a parent or legal guardian, to place an order. By ordering, you confirm that you meet this requirement and that the information you provide is accurate.

2. Your Account

Some features, including subscriptions, require an account. You are responsible for keeping your login credentials confidential and for all activity that happens under your account. Tell us promptly if you believe your account has been accessed without your permission. We may suspend or close an account that we reasonably believe is being used fraudulently or in violation of these Terms.

3. Products, Pricing, and Availability

All prices are in U.S. dollars and are subject to change without notice. We work to keep product descriptions, roast profiles, weights, and images accurate, but we do not warrant that every detail is error-free. Coffee is an agricultural product; specific origins, lots, and flavor characteristics may vary between roasts as harvests change.

Product photography is representative. Bag design, labeling, and packaging may differ slightly from images shown.

We may limit order quantities, restrict sales to any person or region, and discontinue any product at any time.

4. Orders and Acceptance

Your order is an offer to buy. We may accept, decline, or cancel any order for any lawful reason — including suspected fraud, pricing or listing errors, or product unavailability. If we cancel an order you have already paid for, we will refund you in full.

If a product is listed at an incorrect price due to an error, we reserve the right to cancel the order and refund you, even if the order has already been confirmed.

5. Payment

Payment is processed at checkout through Shopify and its payment providers. By submitting payment information, you represent that you are authorized to use the payment method. You are responsible for any applicable sales tax, which is calculated at checkout.

6. Subscriptions

Subscriptions renew automatically at the interval you select and are charged to your saved payment method until you cancel. You can cancel at any time, with no fee, before your next renewal date. Full terms are in our Subscription Policy, which is incorporated into these Terms.

7. Shipping, Title, and Risk of Loss

Shipping timelines, rates, and service areas are described in our Shipping Policy. Title and risk of loss pass to you when we deliver the package to the carrier. That said, if something goes wrong in transit, our Refund Policy tells you how we handle it — we do not use this clause to walk away from a damaged shipment.

8. Returns and Refunds

Because coffee is perishable and roasted to order, we do not accept general returns. Problems with an order are handled under our Refund Policy, which is incorporated into these Terms.

9. Food Safety and Allergens

Our coffee is roasted and packaged in a facility that handles coffee and may handle other food products. We do not certify our products as allergen-free. If you have a serious allergy, contact us before ordering.

10. Wholesale Accounts

Wholesale purchasing is available by approved account only and carries a 40 lb per month minimum. Wholesale pricing, payment terms, and delivery arrangements are set out in a separate agreement between Houdini and the account holder. Where that agreement conflicts with these Terms, the wholesale agreement controls for that account.

11. Acceptable Use

You agree not to use the site to break any law, infringe anyone’s rights, transmit malicious code, scrape or harvest data by automated means, interfere with the site’s operation or security, or resell our products without written authorization.

12. Intellectual Property

The Houdini Coffee Roasters name, logo, blend names, packaging design, site copy, photography, and layout are the property of Houdini Coffee Roasters LLC and are protected by trademark and copyright law. You may not copy, reproduce, or use them commercially without our written permission.

13. Customer Submissions

If you send us reviews, photos, ideas, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and reproduce it in connection with our business, including marketing. You confirm that the content is yours to share and does not violate anyone else’s rights. We are not obligated to use or keep any submission confidential.

14. Third-Party Links and Services

The site may link to third-party sites and relies on third-party services, including Shopify for hosting and payment processing and USPS and other carriers for delivery. We are not responsible for the content, policies, or performance of third parties.

15. Disclaimer of Warranties

The site and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free. Nothing in this section limits the commitments we make in our Refund Policy.

16. Limitation of Liability

To the fullest extent permitted by law, Houdini Coffee Roasters LLC and its members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising from your use of the site or our products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

17. Indemnification

You agree to indemnify and hold harmless Houdini Coffee Roasters LLC from any claim, loss, or expense (including reasonable attorneys’ fees) arising out of your breach of these Terms or your misuse of the site.

18. Governing Law and Venue

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your use of the site will be brought exclusively in the state or federal courts located in Franklin County, Washington, and you consent to the jurisdiction of those courts.

19. Changes to These Terms

We may update these Terms from time to time. The current version is always posted here with its effective date. Changes apply to orders placed after they are posted. Continuing to use the site after an update means you accept the revised Terms.

20. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the rest remains in effect. These Terms, together with our Privacy Policy, Shipping Policy, Refund Policy, and Subscription Policy, are the entire agreement between you and Houdini regarding the site.
